Terms and Conditions

Your access to and use of the Application is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all users and those who wish to access or use the Application. By using or accessing the Application you agree to be bound by these Terms. If you disagree with any part of the terms, please do not access the Application.

General Payment Terms

The application is free to use with a daily limit. Premium features of the Application will require you to pay fees before using the given premium service. Before you make the payment, you will have the opportunity to review and accept the fees that will be charged. The amount vary based on the plans.

Compliance with Law

You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

End User License

We hereby grant you a limited, non-transferable, revocable, non-exclusive license to download, install and use a copy of the application on a permitted device of yours, for your personal, non-commercial purposes.

Feedback

Any feedbacks, comments, or suggestions relating to the Application submitted to us shall become our property. We will not be liable for any, including without limitation, product, application, site, services or advertising ideas and will not incur any liability as a result of any similarities that may appear in the Application, or operations, in the future. Without limitation, we will have exclusive ownership of all present and future existing rights to the Ideas of every kind and nature everywhere and will be entitled to use the Ideas for any commercial or other purpose whatsoever, without compensation to you or any other person submitting the Ideas. You acknowledge that you are responsible for whatever material you send, and you, not us, have full responsibility for the message, including its reliability, legality, appropriateness, originality, and copyright.

Termination

This Agreement is effective unless and until terminated by either you or us. You may terminate this Agreement at any time, provided that you discontinue any further use of the Application. We may also terminate these Terms with you at any time, for any reason, and without advanced notice. We reserve the right in our sole discretion and at any time to terminate or block your use of our Application for any reason including, without limitation if you have failed to comply with these Terms. You agree that we are not liable to you or any third party for any termination of your use of our Application.

Indemnity

You agree, to the extent permitted by law, to indemnify, defend and hold harmless us and our affiliated parties, directors, officers, stockholders, employees, licensors, suppliers, and agents against all claims, demands, causes of action, losses, expenses, damages and costs, including any reasonable attorneys' fees, resulting or arising from, or relating in any way to your Content, your access to or use of the Application or violation of these Terms by you.

Apple App Store — Licensed Application End User License Agreement

The following additional terms apply if you downloaded the Application from the Apple App Store ("App Store Sourced Application"). These terms are incorporated by reference and supplement, and where required by Apple Inc. ("Apple"), supersede the terms above.

Acknowledgment

You and we acknowledge that these Terms are concluded between you and KALLOSSOFT.COM S.R.L. only, and not with Apple, and that Apple is not responsible for the Application or the content thereof. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

Scope of License

The license granted to you for the Application is limited to a non-transferable license to use the Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

Maintenance and Support

KALLOSSOFT.COM S.R.L. is solely responsible for providing any maintenance and support services with respect to the Application, as specified in these Terms, or as required under applicable law. You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

Warranty

KALLOSSOFT.COM S.R.L. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you (if any); and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of KALLOSSOFT.COM S.R.L.

Product Claims

You and we acknowledge that KALLOSSOFT.COM S.R.L., and not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property Rights

You and we acknowledge that, in the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, KALLOSSOFT.COM S.R.L., and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Beneficiary

You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
